Terms of Service

By accessing or using Plinth ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms form a legally binding agreement between you and Ditador Labs LLP ("Company", "we", "us"), a limited liability partnership registered in India. By using the Service you represent that you have the legal capacity to enter into this agreement.

Plinth is a digital governance platform that enables residential housing societies to conduct polls and votes electronically. The platform allows society administrators to create and manage polls, import member rosters, and publish results. Residents can claim their flat, receive notifications, and cast votes.

Plinth is provided as a software-as-a-service (SaaS) platform and is currently available free of charge during our early-access period.

• You must be at least 18 years of age to use this Service.
• Society administrators must be authorised representatives of a registered residential housing society.
• Residents must be the named owner or an authorised occupant of the flat they claim on the platform.
• One flat may have one primary owner account. Multiple accounts for the same flat are not permitted.

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately at support@plinth.in if you suspect unauthorised access to your account.

We are not liable for any loss or damage resulting from your failure to keep your credentials secure. One-time codes and magic links expire after use and cannot be reused.

Society administrators accept these additional obligations:

• Only import member data for individuals who are genuine flat owners or occupants of your society.
• Obtain necessary consent from residents before importing their personal information into the platform, in compliance with applicable data protection laws.
• Ensure that polls are conducted in accordance with your society's bye-laws and applicable law.
• Keep society settings (quorum rules, weighting) accurate and up to date.
• Do not use the platform to conduct polls that are illegal, discriminatory, or that violate members' rights.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
• Attempt to circumvent the one-vote-per-flat restriction or manipulate poll outcomes.
• Submit false, misleading, or fraudulent information when claiming a flat or uploading credentials.
• Attempt to access another user's account or another society's data.
• Use automated scripts, bots, or other means to artificially inflate reaction counts or flood the system.
• Reverse-engineer, decompile, or attempt to extract the source code of the platform.
• Upload malicious files, malware, or content that infringes third-party intellectual property.
• Use the Service to send spam, unsolicited communications, or conduct phishing attacks.

Votes cast on Plinth are final and cannot be reversed once submitted. This mirrors the binding nature of a physical ballot.

The Company does not guarantee that results produced by the platform will be legally binding under all jurisdictions or society bye-laws. It is the administrator's responsibility to ensure that the platform's use complies with the society's governing documents and applicable law. The platform is a tool — not a substitute for legal advice.

The Service, including its design, code, trademarks, and content (excluding user-uploaded documents), is owned by Ditador Labs LLP and protected by applicable intellectual property laws.

You retain ownership of any data you upload (documents, roster data). By uploading data, you grant us a limited, non-exclusive licence to process and store it solely for the purpose of providing the Service.

We aim to provide a reliable service but do not guarantee 100% uptime. We may suspend the Service temporarily for maintenance, security updates, or due to circumstances outside our control (force majeure).

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice, except in cases of emergency security action.

The Service is provided "as is" and "as available" without any warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Service will be error-free, uninterrupted, or free of harmful components.

To the maximum extent permitted by applicable law, Ditador Labs LLP and its officers, directors, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including but not limited to loss of data, loss of profits, or reputational damage.

Our total aggregate liability for any claim arising under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim (or ₹1,000 if no payment was made).

You may stop using the Service at any time. Society administrators may delete their society from the Settings page, which permanently removes all associated data.

We may terminate or suspend your access if you violate these Terms, engage in fraudulent activity, or if required by law. We will provide reasonable notice except in cases of serious violations.

These Terms are governed by the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana, India.

Before initiating formal proceedings, you agree to attempt to resolve any dispute informally by contacting us at legal@plinth.in.

We may update these Terms from time to time. We will provide at least 14 days' notice of material changes by email and by posting the updated Terms on this page. Continued use of the Service after the effective date constitutes acceptance.
